Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of the websites, web widgets, Passenger App, Driver App, Management Dashboard, communities, and related services provided by E-BookNow (“E-BookNow,” “we,” “us,” “our”). By accessing or using our services (collectively, the “Services”), you agree to these Terms and our Privacy Policy.

Platform Only — No Transportation Services: E-BookNow is a technology platform that facilitates bookings, dispatch, and communications among car & limo service companies, drivers, dispatchers, passengers, and affiliates. We are not a transportation carrier or provider, do not employ drivers, do not own or operate vehicles, and do not control third parties. All transportation, safety, pricing, schedules, and service quality are the sole responsibility of the independent third parties who provide such services.

1) Eligibility & Accounts

  • You must be of legal age and capacity in your jurisdiction to use the Services.
  • You are responsible for safeguarding your login credentials and all activity under your account.
  • You agree to provide accurate and current information and to update it as needed.

2) Role & Responsibility Allocation

  • Independent Parties: Drivers, dispatchers, and companies are independent third parties, not employees, agents, or representatives of E-BookNow. They are solely responsible for compliance with laws, licensing, insurance, vehicle condition, driver conduct, schedules, pricing, and customer service.
  • No Duty to Vet: Unless explicitly required by law or expressly stated by us, E-BookNow does not conduct background checks, vehicle inspections, or ongoing monitoring. Any optional verification displayed in the Services is provided “as is,” may be incomplete, and does not constitute endorsement or a safety guarantee.
  • No Control: We do not control third-party availability, punctuality, route selection, fare components, communications, or outcomes of any trip or job.

3) Bookings, Pricing & Payments

  • Quotes may include base fares, tolls, taxes, surcharges (e.g., airport/port fees, congestion), waiting time, extra stops, dynamic pricing, and optional gratuities.
  • Final amounts may change due to route changes, delays, add-ons, or other adjustments. You authorize our payment processor (e.g., Stripe) to charge your payment method.
  • Card data is handled by the processor; E-BookNow does not store full card details. Chargebacks, reversals, and refunds are subject to processor rules and applicable law.

4) Cancellations, Changes & No-Shows

  • Cancellation windows and fees are set by the providing company and may vary by service type and location (e.g., airports, ports, events).
  • No-show fees may apply if a driver arrives as scheduled and you are unreachable or absent after the grace period.
  • Flight monitoring (if enabled) is informational only and may be inaccurate; you remain responsible for providing correct contact and flight details.

5) Acceptable Use; Prohibited Conduct

  • Do not use the Services for unlawful, harmful, or fraudulent purposes; do not harass or endanger any person.
  • Do not interfere with or disrupt the Services; do not introduce malware, scrape, reverse engineer, or attempt to circumvent security.
  • You are solely responsible for content you submit and for compliance with applicable laws and regulations (transportation, privacy, consumer, labor, tax, etc.).

6) Service Availability; Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, E-BOOKNOW DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE.

  • No Guarantee of Accuracy or Uptime: We do not warrant that the Services will be uninterrupted, timely, secure, error-free, or accurate.
  • No Responsibility for Third Parties: We are not responsible for acts or omissions of drivers, dispatchers, companies, passengers, affiliates, or any third parties, including delays, cancellations, accidents, property damage, personal injury, loss, or unlawful conduct.
  • No Responsibility for Misuse or Malfunction: We are not liable for misuse of the Services, incorrect inputs, device issues, connectivity problems, SDK/OS updates, or third-party integrations (maps, payments, analytics, flight data, messaging, etc.).
  • No Professional Advice: Information provided in the Services is for convenience only and does not constitute professional or legal advice.

7) Limitation of Liability

  • TO THE MAXIMUM EXTENT PERMITTED BY LAW, E-BOOKNOW SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES.
  • TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU PAID TO E-BOOKNOW IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) USD $100.
  • THE LIMITATIONS ABOVE APPLY TO ALL THEORIES OF LIABILITY, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8) Indemnification

You agree to defend, indemnify, and hold harmless E-BookNow and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (i) your use of the Services; (ii) your violation of these Terms or applicable law; (iii) your content; (iv) your interaction with third parties (drivers, dispatchers, companies, passengers, affiliates); or (v) any allegation that your content or conduct infringes or violates third-party rights.

9) Third-Party Services & Integrations

The Services may link to or integrate with third-party services (e.g., maps/geocoding, payment processing, analytics, messaging, flight data). Your use of third-party services is subject to their terms and privacy policies. We are not responsible for third-party availability, accuracy, security, or practices.

10) Intellectual Property

  • E-BookNow owns or licenses the Services and associated content. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services as intended.
  • You may not copy, modify, distribute, sell, lease, reverse engineer, or otherwise exploit the Services except as permitted by law.

11) Data & Privacy

Our Privacy Policy describes how we collect, use, and share information. By using the Services, you consent to our data practices as described therein.

12) Suspensions & Termination

  • We may suspend or terminate access for any reason, including suspected fraud, misuse, safety risks, legal non-compliance, or violation of these Terms.
  • You may stop using the Services at any time; you remain responsible for any outstanding amounts.
  • Upon termination, provisions that by their nature should survive (e.g., IP, disclaimers, limitations, indemnification, governing law) will survive.

13) Force Majeure

We shall not be liable for delays, failures, or unavailability due to events beyond our reasonable control, including natural disasters, strikes, wars, terrorism, civil unrest, epidemics/pandemics, government actions, utility or internet outages, or third-party service failures.

14) Dispute Resolution; Governing Law; Class Action Waiver

  • Governing Law: These Terms are governed by the laws of , without regard to conflict-of-laws principles.
  • Informal Resolution: Before initiating a claim, you agree to first contact us at legal@e-booknow.com and attempt to resolve the dispute informally within thirty (30) days.
  • Arbitration: Except for small claims or injunctive relief, disputes shall be resolved by binding individual arbitration under the rules of . YOU WAIVE THE RIGHT TO A JURY TRIAL.
  • Class Action Waiver: DISPUTES MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

15) Changes to the Services or these Terms

  • We may modify or discontinue any part of the Services at any time, subject to applicable law.
  • We may update these Terms from time to time. We will post the updated Terms with the “Effective date” above. Your continued use constitutes acceptance.

16) Assignment

We may assign these Terms in connection with a merger, acquisition, corporate reorganization, or sale of assets. You may not assign these Terms without our prior written consent.

17) Severability; Waiver

If any provision is found unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions will remain in full force. Our failure to enforce any right is not a waiver of that right.

Driver/Company/Dispatcher Disclosures (Summary)

  • You are solely responsible for all licenses, permits, insurance, regulatory compliance, and tax obligations in the jurisdictions where you operate.
  • You must ensure vehicle safety, maintenance, and lawful operation. Do not use the app while driving if it compromises safety or violates law.
  • You acknowledge that passengers are third parties and E-BookNow is not a party to your agreements or disputes with them.
  • You agree to promptly handle customer service issues, lost-and-found, damage claims, delays, and refunds according to applicable law and your own policies.
